concerning the short term rental of the property located at
5215 Yoakum, Houston, TX 77006 in Harris County (The Museum House).

Terms of the Agreement:
You get the deposit back... Rental Deposit amount is fully refundable up to 60 (sixty) days prior to the beginning of the rental period. If canceled less than 60 days prior to the rental period the Owner shall retain the initial Rental Deposit. Cancellations must be in writing or by email. If all is well, the Security Deposit will be promptly refunded in full within 3 days of departure.
Check in/out is easy... Guest may not occupy the Premises before 3pm on the beginning date and that he/she will vacate the premises on or before 10.30 am on the ending date. Call 713.526.4028 about an hour prior check-in so that we can meet you at the property and call the same number prior to check-out. Guest must provide a valid credit card upon booking for deposit, payments and security for damages and repairs.  Balance will be charged to the credit card that you reserved the unit with, unless other arrangements are made prior to payment date. Guest agrees to pay all charges prior to arrival.  A deposit of $350.00 is due on day of booking.   Balance of rental invoice is due  30 Days prior to check-in. We require a drivers license and valid credit card at check-in.
Beautiful furnishings and contemporary art pieces... Inventory photos of furnishings and art work will be made at upon check-in with guest present and compared at checkout. Please realize that the Museum House houses a variety of Original Art Works which can be very costly if damaged. Please use special care. Thank you!  Guest shall be responsible for maintaining and returning said furnishings and property to Owner at the end of the subject Rental Agreement in the same condition it was in upon occupancy, except for normal wear and tear.  Any damaged or missing personal property shall be deducted from the security deposit and/or charged to the credit card presented at check-in at replacement value.
How many are staying?...  The maximum occupancy is 4 adults to sleep or reside at the premises unless otherwise agreed. We do not rent to students or singles under 25 years of age unless accompanied by an adult guardian or parent.
Let's keep it quiet... Occupancy of the homes and decks and use of community walkways, pools and other common areas shall be sufficiently quiet and peaceful so as not to disturb others.  Please be considerate of our neighbors.
Sorry, no pets... Please, no animals or pets of any kind are allowed in the house. It has all white carpet!
No smoking, please... Smoking is not allowed in the Museum House. We appreciate your understanding. If evidence of cigarette smoke is discovered in the home you will be billed $300.00 + repair cost.
Cleaning every week... Rates include a weekly linen and towel setup. The $75 cleaning fee is only charged once, regardless of the length of stay.
Free Internet & Dish 250 channel Cable TV... High speed wireless Internet and Cable TV is provided as a convience only and is not integral to the agreement. No refund of rents shall be given for outages, lack of HD, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to Internet service and Cable TV. You agree that any PAY PER VIEW rentals bill be charged to the credit card on file.
We return your valuable items... The owner is not responsible for loss or damage to any valuables. Valuable items left behind by guest will be held for the guest and every reasonable effort will be made to contact the guest for return. If items are not claimed for longer than 6 months they shall become the property of the Owner. The Owner shall not be held liable for condition of said items.
It's a Temporary Stay... Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guests do not intend to make the property a residence or household.
Your security is important... The property has fire alarms installed and they are believed to function properly at the time of rental. Guest will notify management without delay if a fire alarm “chirps” or has a low battery condition. Guest is advised that there is no carbon monoxide detector on the property and accepts the risk involved in not having one. Guest shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it’s prudent to do so. The property has a fire extinguisher installed in the kitchen. The fire extinguisher was fully charged at last inspection. It is the duty of the guest to inform owner should the fire extinguisher becomes less than fully charged. Guest agrees to use the fire extinguisher only for true emergencies. Fire alarms are provided and operational.
The beautiful Pool... Guest agrees to have a responsible adult supervising minors while they swim in the pool. Guest is hereby notified that the pool can be dangerous and guest accepts fully the risks involved. Guest is further notified to be cautious when exiting the rear of the home as the pool is open and in close proximity to the entry ways and can be a hazard. There are no rails to prevent a fall into the pool. The outdoor, patio area and swimming pool is open daily from 1:00 PM till 5:00 PM. There is no lifeguard on duty. An adult MUST accompany children under the age of 14. Glass is not allowed in the Pool Area.
No illegal activities, please... Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Guest acknowledges and agrees that Owner may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, engages in illegal activities violates any of the terms of this Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed on by the parties prior to check out.

Other Legal Stuff.... Guests listed or not listed shall hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or those whom they invite to use the premises. Guests expressly recognize that any insurance for property damage or loss, which the Owner may maintain on the property, does not cover the personal property of Guests, and that Guests should purchase their own insurance for Guests and Guests if such coverage is desired. Guests agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Owner enforcing this agreement. Any Noncompliance with rules or violations of law may result in eviction from property and forfeiture of  all funds paid. Your signature on this agreement, or payment, or taking possession of the property after the receipt of agreement, is evidence of your acceptance of this agreement.
